UAE Gratuity for Indians: How End-of-Service Pay Works in 2026

1. What is UAE gratuity?

UAE gratuity (also called end-of-service benefit) is a mandatory lump-sum payment your employer must pay when your employment ends — whether you resign, are terminated, or your contract expires. It is guaranteed by UAE Labour Law for anyone who completes at least one year of service.

Think of it as a forced savings scheme on top of your salary. You don't contribute anything — your employer pays it entirely. For an Indian working in Dubai for 3–5 years, this can add up to 3–6 months of salary as a single payout when you leave.

2. How is gratuity calculated?

3. The basic salary trap — most Indians miss this

This is the most common mistake Indians make when evaluating a Dubai offer. Gratuity is calculated on your basic salary, not your total package.

Most Dubai contracts split pay into:

If your gross is AED 15,000 but your basic is only AED 6,000, your gratuity is calculated on AED 6,000 — not 15,000. That is a 60% difference in your end-of-service payout.

Common questions

Do I get gratuity if I resign before 1 year?

No. UAE labour law requires at least one full year of service for any gratuity entitlement. If you leave before completing 12 months, you receive nothing under the gratuity rules, regardless of the reason.

Is UAE gratuity taxable in India?

It depends on your tax residency status. Many Indians working in the UAE are NRIs for tax purposes and may not be taxed in India on UAE-source income. However, the rules are specific and changing — consult a qualified tax advisor before repatriating large sums.

Can my employer refuse to pay gratuity?
